Founding Customers - Terms And Conditions

These terms explain how our Founding Customer Programme works, what you're agreeing to when you apply, and how we use the photographs and information you give us. By applying you're agreeing to them.

The offer, and who can apply

The Founding Customer Programme is open to twelve UK customers, selected by us from the applications we receive. Applying does not guarantee a place. We select for a spread of cushion types and settings rather than first-come-first-served, and we respond to every applicant either way.

The programme is open to customers in mainland UK, aged 18 or over. It's limited to one order per household, and it can't be combined with any other discount or promotion.

The price

Selected customers pay our cost price for their order, the cost of materials, manufacture, and delivery to us, with no margin added. The exact price is confirmed to you in writing before you pay anything. Delivery within mainland UK is free.

What we ask in return

We ask that, within one month of delivery, you send us:

  • a few photographs of your cushions where they live, and
  • an honest review of them.

Your price is not conditional on this. If you'd rather not, or you simply forget, we won't chase you or charge you the difference. If you do send us photographs we're able to use, we'll send you a thank-you on top, and we'll tell you what that is when your order goes out.

Photographs, and how we use them

When you send us photographs as part of the programme, you give us permission to use them, your review, and your first name to promote Cushionfit, on our website, on social media, in emails, in print, and in paid advertising, without further payment or approval.

A few specifics, so we all know where we stand:

  • This permission continues after your order, and covers editing photos for size, crop, and colour. It doesn't change who owns the photographs, you do.
  • We're not obliged to use any particular photograph, and if you later ask us to stop using an image of yours, we will, going forward.
  • If a photograph shows people who can be identified, and especially if it shows children, you confirm that they (or a parent or guardian) are happy for it to be used in this way.

Reviews

We won't edit your review, or refuse to publish it, because it's critical. If it's fair, it stands as you wrote it.

Where we publish reviews from the programme, we'll label them clearly as coming from founding customers who received their order at cost price, so readers know the full picture.

Your consumer rights

Cushions made to your measurements are custom-made goods. Under the Consumer Contracts Regulations 2013, custom-made goods are excluded from the standard 14-day right to cancel, and that applies to founding customer orders as it does to any custom cushion order. Your statutory rights in respect of faulty or misdescribed goods are unaffected.

Your information

When you apply, we collect your name, email, and the answers you give us. We use these to assess your application, to contact you about the programme, and, in aggregate, to understand what customers want and improve what we offer. Our lawful basis is our legitimate interest in running and improving the business, and your consent where you've given it.

We don't sell your information. If you're not selected, we keep your application for up to 12 months and then delete it. For the full picture of how we handle personal data, including your rights to access or delete it, see our Privacy Policy.

Lead time and practicalities

Lead time is approximately two weeks from the point we confirm your specification. Applications close on 31/08/2026, or once twelve places are filled, whichever comes first.

Changes to the programme

We may amend these terms or close the programme early, including before the closing date, at our discretion. Any change won't affect an order we've already confirmed with you in writing.

Governing law

These terms are governed by the law of England and Wales, and any disputes will be subject to the courts of England and Wales.
